OF PETITION TO FORECLOSE THE RIGHT TO REOPEN
A PORTION OF A CERTAIN PUBLIC ALLEY OR ROADWAY
NOTICE IS HEREBY GIVEN that the Housing Authority of the Chickasaw Nation, Petitioner in the above-captioned and numbered cause, has filed a verified Petition requesting that the Court foreclose the right to reopen a certain portion of a certain public way in the City of Purcell, McClain County, Oklahoma (hereinafter referred to as the “Subject Property”), with said portion being more particularly described, to-wit:
All of that portion of the East Twenty (20) feet of the West Forty (40) feet of that portion of North 9th Avenue between West Jefferson Street and West Jackson Street in the City of Purcell, McClain County, Oklahoma, dedicated to the public as an alley or roadway by Ordinance No. 595 enacted on November 23, 1956, insofar as it is adjacent to the following described property, to-wit:
All that part of a tract of land described in Book 1749, Page 989 and all that part of a tract of land described in Book 1411, Page 205 and all that part of a tract of land described in Book 2810, Page 54, and part of vacated Ninth Avenue as described in Book 258, Page 369, and the North 30 feet of vacated Monroe Street as recorded in Book 483, Page 337, all being part of Block 63, City of Purcell, McClain County, Oklahoma, and being more particularly described by metes and bounds as follows: Commencing at the Northeast corner of Lot 3, Block 63; thence S02º57’05”W along the East line of said Lot 3 for a distance of 50.00 feet to the point of beginning; thence continuing S02º57’05”W for a distance of 180.00 feet to a point on the centerline of vacated Monroe Street as recorded in Book 483, Page 337; thence N86º52’19”W along said centerline for a distance of 147.72 feet to a point on the West line of the East 20 feet of vacated Ninth Avenue as recorded in Book 258, Page 369; thence N00º25’30”W parallel with the West line of the SW/4 of Section 1, Township 6 North, Range 2 West, same being parallel with the West line of the Original Townsite of Purcell, for a distance of 180.35 feet; thence S86º52’19”E for a distance of 158.34 feet back to the point of beginning and containing 0.63 acres, more or less,
and being previously sometimes described as:
Part of Lots 3 and 4 of Block 63 of the City of Purcell, McClain County, according to the official plat and U.S. Government Survey thereof, more particularly described as follows: Beginning at a point 50 feet South of the Northeast corner of Lot 3 of said Block 63 and running thence West 141.1 feet to the West side of Lot 4; thence South 50 feet; thence East 141.1 feet to the East side of Lot 3; thence North 50 feet to the point of beginning,
AND,
Part of Lots 3 and 4 of Block 63 of the City of Purcell, McClain County, Oklahoma, according to the official plat and U.S. Government Survey thereof, more particularly described as follows: Beginning at a point 100 feet South of the Northeast corner of Lot 3 of said Block 63 and running thence West 141 feet to the West side of Lot 4; thence South along the West side of Lot 4, for 50 feet; thence East 141 feet to the East side of Lot 3 and thence North to the point of beginning,
AND,
Part of Lot 4 of Block 63 of the City of Purcell, McClain County, Oklahoma, according to the official plat and U.S. Government Survey thereof, more particularly described as follows: Beginning at a point 150 feet South of the Northeast corner of Lot 4 and running West to the West side of said Lot 4; thence South 50 feet; thence East to the East line of Lot 4; thence North 50 feet to the point of beginning,
AND,
Part of Lot 3 and Block 63 of the City of Purcell, McClain County, Oklahoma, according to the official plat and U.S. Government Survey thereof; more particularly described as follows: Beginning at a point 150 feet South of the Northeast corner of said Lot 3 and running West 70 feet, thence South 50 feet, and thence East 70 feet; thence North 50 feet to the point of beginning.
The above request to foreclose the right to reopen said portion of said public way will be presented to Judge Charles Gray, McClain County, Oklahoma, on the 28th day of May, 2026, at 10:30 o’clock A.M., or as soon thereafter as possible.
Anyone in opposition to this Petition to foreclose the right to reopen said portion of said public way shall file an answer showing the grounds for opposition to the Petition within twenty (20) days after the date of publication of this notice.
