PETITION TO QUIET TITLE

AND VACATE EASEMENT

The public take notice that Plaintiffs have filed his application in the District Court of McClain County, Oklahoma, requesting said Court to enter a decree to vacate and foreclose a reopening of a certain easement located in Wayne County, State of Oklahoma, more particularly described as follows, to‑wit:

All of Block Three (3), less the East Seventy-Five (75) feet thereof, “Y” Addition to the Town of Wayne, McClain County, State of Oklahoma, according to the recorded plat thereof and that portion of land described in Quit Claim Deed filed at the McClain County Clerk in Book 3071 at Page 101, said tract of land being more particularly described as follows, to wit: 

COMMENCING at the Northeast corner of said Block Three (3); thence South 89°22’57” West along the North line of said Block Three (3), a distance of 75.00 feet to the point of beginning; thence South 00°42’10” East at a distance of 342.17 feet to the North Right-of-Way line of State Highway No. 59; thence along said North Right-of-Way line on a non-tangent curve to the right having a radius of 439.17 feet, a chord bearing of North 54°05’06” West, a chord distance of 15.86 feet and an arc length of 15.86 feet; thence South 00°39’26” East continuing along said North Right-of-Way line, a distance of 44.97 feet; thence South 89°31’34” West continuing along said North Right-of-Way line, a distance of 78.87 feet to the East Right-of-Way line of U.S. Highway No. 77; thence North 18°16’26” West along said East Right-of-Way line, a distance of 396.56 feet to the South Right-of-Way line of Kerr Street; thence South 89°47’22” East along said South Right-of-Way line, a distance of 26.36 feet; thence North 89°22’57” East along said South Right-of-Way line, a distance of 185.00 feet to the POINT OF BEGINNING.

Also Known as: 

All of Block Three (3), Less the East 75 feet thereof, Y Addition to the Town of Wayne, McClain County, Oklahoma, according to the recorded plat thereof

AND

A strip, piece, or parcel of land lying in part of the SE/4 SE/4 SW/4 of Section 9, T5N, R1W and adjacent to the West line of Block 3 of the “Y” Addition to the Town of Wayne, McClain County, Oklahoma. Said parcel of land being described by metes and bounds as follows:

BEGINNING at Northwest corner of said Block 3, said point being on the Present East Right-of-Way line of US-77; thence S18°16’26”E along the West line of said Block 3 and said Present Right-of-Way line a distance of 231.91 feet; thence Southeasterly along the West line of said Block 3 and said Present Right-of-Way line on a curve to the left, having a radius of 439.708 feet and an arc distance of 237.66 feet (having a chord bearing of S 48°41”06” E and a chord distance of 234.78 feet) to a point on the Permanent North Right-of-Way line of SH-59; thence S 89°31’34” Wand Parallel with the centerline of SH-59, along said Permanent North Right-of-Way line, a distance of 151.08 feet to a point on the  Permanent East Right-of-Way line of US-77; thence N 18°16’26” W along the said Permanent East Right-of-Way line a distance of 396.56 feet to a point on the Permanent South Right-of-Way line of Kerr Street, thence S 89°47’33” E along said Permanent South Right-of-Way line a distance of 26.36 feet to said POINT OF BEGINNING

And that said Petition and application has been set for hearing on the 4 day of November, 2026, at 9 o’clock A.M., in Room 2 in the  McClain County Courthouse, McClain, Oklahoma, at which time interested parties may appear and show cause, if any there be, why such relief prayed for by applications should not be granted.
