ORDINANCE NO. 2026-3-15

AN ORDINANCE OF THE TOWN OF COLE ADDING SECTION 15-32 OF ARTICLE 3 OF CHAPTER 15, TOWN OF COLE CODE OF ORDINANCES ENTITLED “PLANNING AND COMMUNITY DEVELOPMENT”, OF THE CODE BY ADDING SAID SECTION 15-32, ESTABLISHING MINIMUM LOT SIZE REQUIREMENTS FOR THE SUBDIVISION, DIVISION, OR DEVELOPMENT OF LAND WITHIN THE MUNICIPAL LIMITS; LEAVING ALL OTHER LANGUAGE IN ARTICLE 3 UNCHANGED; PROVIDING FOR SEVERABILITY, REPEALER, AND EFFECTIVE DATE.

BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES OF THE TOWN OF COLE, OKLAHOMA:

SECTION 1: That Article 3 of Chapter 15 of the Town of Cole Code of Ordinances is hereby amended to add Section 15-32 and shall, from and after the effective date of this Ordinance, Section 15-32 of said Article 3 shall read as follows:

“Section 15-32. Minimum Lot Size Requirements.

  1. Applicability. This Ordinance shall apply to all real property located within the incorporated limits of the Town of Cole, Oklahoma.
  2. No person, firm, corporation, trust, partnership, or other entity shall divide, subdivide, plat, convey, transfer, develop, or create any lot, tract, parcel, or building site containing less than five (5) acres.
  3. No building permit, utility connection, or other municipal authorization shall be issued for any lot created in violation of this Ordinance.
  4. No lot may be reduced below five (5) acres by metes and bounds conveyance, partition, inheritance division, survey, platting action, or other method of land division unless otherwise exempted herein.
  5. Exemptions. The following shall be exempt from the minimum lot size requirements:
  6. Lots lawfully existing prior to the effective date of this Ordinance;
  7. Boundary line adjustments between adjoining property owners where no additional nonconforming lot is created;
  8. Public utility easements or governmental acquisitions;
  9. Cemetery property;
  10. Court-ordered partitions where strict compliance is impossible, provided the resulting tract is the largest practicable size under the circumstances; and
  11. Property acquired by the municipality, county, state, or federal government for public purposes.
  12. Enforcement. The Town may enforce this Ordinance through any lawful means including:
  13. Municipal citations;
  14. Injunctive relief;
  15. Denial of permits or utility services;
  16. Civil actions;
  17. Abatement proceedings; and/or
  18. Any combination of remedies authorized by Oklahoma law.”

SECTION 2. That the remaining language of Article 3 of Chapter 15 of the Town of Cole Code of Ordinances shall remain unchanged by this Ordinance.

SECTION 3. Severability. If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the remaining portions of this ordinance.

SECTION 4: Repealer. All ordinances or parts of ordinances, in conflict herewith are hereby repealed.
