RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MCCLAIN COUNTY, OKLAHOMA, FINDING THAT REQUIREMENTS FOR INCORPORATION OF THE TOWN OF SELAH HAVE BEEN FULLY COMPLIED WITH; CALLING A SPECIAL ELECTION FOR THE PURPOSE OF SUBMITTING TO REGISTERED VOTERS OF THE PROPOSED TOWN THE QUESTION OF WHETHER THE PROPOSED TOWN WILL BECOME AN INCORPORATED TOWN; AND PROVIDING FOR PUBLICATION AND POSTING OF NOTICE.

WHEREAS, on February 17, 2026, the Board of County Commissioners of McClain County, Oklahoma (“BOCC”) received a presentation of the Petition for Incorporation of the Town of Selah and related documents (“Petition”); and

WHEREAS, the territory to be included within the proposed Town of Selah, Oklahoma is entirely within McClain County, and is shown on Exhibit A hereto (the “Proposed Town Territory”) and described on Exhibit B hereto; and

WHEREAS, the Petition contained all of the information required by Section 3-101(B) of Title 11 of the Oklahoma Statutes, verified by affidavits, and upon inquiry, it appears to the BOCC that the statutory requirements in Title 11 of the Oklahoma Statutes have been fully complied with; and

WHEREAS, based on its understanding that the requirements for incorporation have been fully complied with, the BOCC is required to call an election for the purpose of submitting to the registered voters of the Proposed Town Territory the question of whether or not it shall become an incorporated town.

NOW, THEREFORE, BE IT RESOLVED that the BOCC hereby determines, pursuant to Section 3-102 of Title 11 of the Oklahoma Statutes, that the requirements for incorporation of the Proposed Town have been fully complied with; and

BE IT FURTHER RESOLVED that the BOCC hereby calls a special election to be held by the McClain County Election Board on June 16, 2026 (the “Election Date”), for the purpose of submitting to the voters residing within the Proposed Town Territory the question of whether or not the proposed Town of Selah shall become an incorporated town, and directs that a certified copy of this Resolution be provided to the McClain County Election Board; and

BE IT FURTHER RESOLVED that the ballot title attached hereto as Exhibit C sets forth the gist of the ballot to be used; and

BE IT FURTHER RESOLVED that the County Clerk is hereby directed to cause notice of such election to be given to the public at least 10 days prior to the Election Date, pursuant to Section 3-103 of Title 11 of the Oklahoma Statutes, as follows:

1. By publishing this Resolution and exhibits, in a weekly newspaper of general circulation within the proposed town; and
2. Posting this Resolution and exhibits in a minimum of 10 prominent locations within the boundaries of the proposed town.
