RESOLUTION NO. 26-P02

A RESOLUTION OF THE PURCELL PUBLIC WORKS AUTHORITY, PURCELL, OKLAHOMA, AMENDING RESOLUTION NO. 24-P03 CONCERNING WATER RATES AND SEWER RATES AND RESCINDING ANY AND ALL RESOLUTIONS IN CONFLICT THEREWITH.

WHEREAS, the Trustees of the Purcell Public Works Authority (herein after referred to as the Authority) are lessees of the utility system owned by the City of Purcell, Oklahoma; and

WHEREAS, the Authority is charged with the duty of establishing rates for said system;

and

WHEREAS, the Authority deems it necessary and in the best interest of the Trust Estate and for the beneficiary of the Authority, the City of Purcell, Oklahoma, to implement a sewer service rate increase to be effective for the usage period that appears on the July 2026 billing statement; and

WHEREAS, the Authority deems it necessary and in the best interest of the Trust Estate and for the beneficiary of the Authority, the City of Purcell, Oklahoma, to implement a water service rate to be effective for the usage period that appears on the July 2026 billing statement.

NOW, THEREFORE, BE IT RESOLVED BY THE TRUSTEES OF THE PURCELL PUBLIC WORKS AUTHORITY:

Section 1. Effective the start date of the water usage period that appears on the July billing statement and adjusting bi-annually thereafter based on an increase in the two-year cumulative change in the year-end Bureau of Labor Statistics Consumer Price lndex that is used to determine water cost from the well field, the water and sewer rates for Purcell customers shall be as follows:

WATER RATES

Section 2. The category of service provided through the Purcell water system that is leased to the Authority as aforesaid shall be as hereinafter defined.

Section 3. The following terms shall have the meanings respectively ascribed to them below unless the context clearly requires otherwise:

Residential Unit, means any single-family dwelling or any single-family unit, whether located in a separate structure, apartment, group of rooms or residences, having a single kitchen, which is connected with an Authority water meter, and which is not using such water meter in connection with, or in conjunction with, another family dwelling or unit. Included in this definition are churches, schools, and government consumers.

Commercial Unit means all premises other than those defined as “residential units”.

City means within the corporate Iimits of Purcell.

Rural means not within the corporate limits of Purcell.

Section 4. Effective the start date of the usage period that appears on the July 2026 billing statement the monthly rates and charges for water service rendered through the utility system of the City of Purcell, Oklahoma shall be as follows:

All rates over the minimum are calculated for increments of 1,000 gallons or a fraction thereof.

SEWER RATES

Section 5. The category of service provided through the Sanitary Sewer System of the City of Purcell leased to the Authority as aforesaid shall be and remain the category currently defined and set forth in the City Code of Ordinances of the City of Purcell, Oklahoma.

Section 6. Effective the start date of the usage period that appears on the July 2026 billing statement the monthly rates and charges for service rendered through the Sanitary Sewer System of the City of Purcell, Oklahoma shall be as follows:

Residential Sewer Rates

$19.73 per month for 0-999 gallons, plus

$1.73 per 1,000 gallons for 1,000-4,999 gallons, plus

$2.10 per 1,000 gallons for 5,000 gallons and above.

Commercial Sewer Rate

$27.00 per month for 0-999 gallons, plus

$2.97 per 1,000 gallons for 1,000-4,999 gallons, plus

$3.71 per 1,000 gallons for 5,000 gallons and above.

(All rates over the minimum are calculated for increments of 1,000 gallons or a fraction thereof)

Section 7. Repeal/rescind: all ordinances or parts of ordinances, and all resolutions or parts of resolutions in conflict herewith, are hereby repealed, or rescinded.

Section 8. The provisions currently in force and effect providing for late payment and penalties and sanctions for non-payment for the aforesaid service shall remain in effect.

Section 9. All customers using water shall keep their service pipes and other water apparatus in good repair and in proper operation. Adjustments to accounts will not be made for leaks or service problems beyond the Authority’s meter tap or controI except as described in Resolution 12-P01.
