ORDINANCE  NO. 26-08

AN ORDINANCE OF THE CITY OF PURCELL, OKLAHOMA REPLACING AND AMENDING CHAPTER 22 (CEMETERIES) SECTION 22-3 (CEMETERY BOARD) OF THE PURCELL CODE OF ORDINANCES GOVERNING THE PURCELL CEMETERY BOARD; PROVIDING FOR REPEALER; AND PROVIDING FOR SEVERABILITY.

WHEREAS, the City of Purcell (hereinafter “City” or “Purcell”) is a municipal corporation organized and existing under and by virtue of the laws of the State of Oklahoma and is a home rule charter municipality; 

WHEREAS, the City created a Cemetery Board of Trustees (the “Board”) pursuant to 11 O.S. Section 26-106 and Article I, Section 3 of the City Charter and reflected in Chapter 22, Section 3 of the City Code of Ordinances. 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PURCELL, OKLAHOMA:

Section 1. Amendment. 

Section 22-3 of the Purcell Code of Ordinances is hereby amended to read in its entirety as follows:

1. A Cemetery Board is created to be composed of three (3) members. The members of the Cemetery Board shall be appointed as provided in Section 2-86 and shall serve without salary.
2. A Cemetery Board shall act in an advisory capacity to the City Council and shall, from time to time, make recommendations for improvements in the maintenance and operation of the City cemetery system. The Cemetery Board shall also inquire into complaints and recommend solutions of such complaints to the City Council.

Section 2. Repealer.

All other ordinances parts of ordinances in conflict herewith are hereby repealed. 

Section 3. Severability.

If any section, sentence, phrase or portion of this resolution is for any reason held invalid by any court of competent jurisdiction, such provision shall be deemed an independent provision, and such holding shall not invalidate the remaining portions hereof.
