ORDINANCE 26-05

AN ORDINANCE OF THE CITY OF PURCELL, OKLAHOMA, AMENDING THE OFFICIAL ZONING DISTRICTS MAP OF SAID CITY, BY CHANGING THE ZONING DISTRICT CLASSIFICATION FOR THE TRACT OF LAND DESCRIBED HEREIN; AUTHORIZING THE CHANGE OF SAID ZONING DISTRICT OF THE OFFICIAL ZONING DISTRICTS MAP OF SAID CITY. 

WHEREAS, the City has provided notice and conducted a public hearing upon said proposed Zoning District change, all in accordance with Oklahoma Statutes and the City’s adopted Zoning Ordinance. 

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF PURCELL, OKLAHOMA, TO WIT: 

SECTION I. TRACT RE-ZONED:

The official Zoning Districts Map of the City of Purcell, Oklahoma, is hereby amended by changing the Zoning District Classification of the following tract of land to: PUD (Planned Unit Development).

A tract of land in the Northeast Quarter of the Northwest Quarter (NE¼ NW¼) of Section One (1), Township Six (6) North, Range Two (2) West, McClain County, Oklahoma, more particularly described as follows:  Commencing at the NE/Corner of said NW¼; thence S89°33’54”W along the North line of said Section 1 a distance of  400.61 feet; thence S00°26’06”E a distance of 35.87 feet to the true Point of Beginning; thence S45°21’26”E a distance of 21.18 feet; thence S00°16’45E a distance of 587.64 feet; thence S89°54’01”W a distance of 632.33 feet; thence N9°20’07”W a distance of 528.26 feet; thence N32°36’09”E a distance of 47.81 feet; thence N78°02’40”E a distance of 50.18 feet; thence N89°33’54”E a distance of 64.47 feet; thence N62°53’51”E a distance of 60.01 feet; thence N89°33’54”E a distance of 507.35 feet to the Point of Beginning. 

SECTION II. CHANGE TO ZONING MAP AUTHORIZED.

Said amendment hereinabove described is authorized to be added to the Official Zoning Districts Map of the City of Purcell, Oklahoma, by the City Clerk. 

SECTION III.  SEVERABILITY.

If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, said portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance.

SECTION IV.  REPEALER.

All ordinances or parts of ordinances in conflict herewith are hereby repealed.
