NOTICE OF SEIZURE AND
INTENDED FORFEITURE
Notice is hereby given, pursuant to Title 63 O.S. § 2-101 et seq., of the seizure and intended forfeiture of the above-captioned $40,220.00 in U.S. Currency, hereinafter referred to as “currency.”
Said currency was used illegally on or about the 21st day of February, 2024, in McClain County, State of Oklahoma, which currency represents proceeds from the sale of controlled dangerous substances, and further, which currency was found in close proximity to controlled dangerous substances, and used in violation of the Uniform Controlled Dangerous Substance Act, and in violation of the laws of the State of Oklahoma relating to the possession or facilitation of controlled dangerous substances as defined in the laws of this State, 63 O.S. § 2-503(A)(6)&(7).
Further notice is hereby given that the above-described currency is now being held by and in the possession of the District 21, District Attorney’s Office.
Further, notice is hereby given that within forty-five (45) days after mailing or publishing this Notice, the owner of the above-described currency and any other party in interest or claimant thereto, may file a verified answer with the Clerk of the District Court of McClain County, Oklahoma, claiming the said currency and by serving a copy of such claim upon the District Attorney of McClain County, Oklahoma.
Further, notice is hereby given that within forty-five (45) days after mailing or publishing this Notice, the owner of the above-described currency and any other party in interest or claimant thereto, may file a verified answer with the Clerk of the District Court of McClain County, Oklahoma, claiming the said currency and by serving a copy of such claim upon the District Attorney for McClain County, Oklahoma.
Further, notice is hereby given that at the end of forty-five (45) days after this Notice has been filed or published and there has been no verified answer filed, the District Court of McClain County, Oklahoma, shall hear evidence upon the facts of the unlawful use of the above-described currency and shall order said property forfeited to the State of Oklahoma if such facts be proven.
