Motel troubles

A limited liability company which owns the Holiday Inn Express in Purcell has been sued in McClain County District Court after allegedly failing to pay a subcontractor in full for HVAC work.

Defendants in the lawsuit are SRN Hotels LLC, Force Contracting Inc.,Quail Creek Bank and the McClain County Treasurer.

In the civil lawsuit, Mountain Aire LLC, an Edmond company, claims it contracted directly with SRN Hotels on Feb. 18, 2019 to install and complete heating, venting and air conditioning in the hotel at 2300 S. 9th Ave.

Three days later, Mountain Aire contracted with Force Contracting, another Edmond company, to complete additional HVAC work at the hotel.

According to the lawsuit, the approved estimate for all work was $269,000.

However the two companies paid $238,000 to Mountain Aire before they stopped responding to invoices, according to the lawsuit.

The final invoice for $30,500 also went unpaid.

Mountain Aire completed their work on March 18, 2020, and demanded payment which wasn’t made.

On May 29, Mountain Aire filed a mechanic’s lien on the hotel for the unpaid work.

It was then, according to the lawsuit, that SRN Hotels sent a letter putting Mountain Aire on notice that irregularities were present in its work and required remediation.

Mountain Aire then asked for a detailed final punch list of work needing remediation.

Neither SRN Hotels nor Force Contracting responded to the request, according to the lawsuit.
